Cases considering section 11I 6

A (A Child)

[2013] EWCA Civ 1104 · 6 September 2013Interprets

The court interpreted the provision as requiring an enforcement warning to accompany every contact order and as removing judicial discretion over whether to attach such a warning (see para [13]).

O (A Child)

[2009] EWCA Civ 1266 · 2 November 2009Interprets

Interprets s.11I as requiring a warning notice where the court makes a contact order. The court held that it was arguable that the provision did not authorise a warning notice attached to a shared residence order. (see paras [13]–[16])

CH v CT

[2018] EWHC 1310 (Fam) · 25 May 2018Interprets

Interprets the statutory warning notice as distinct from a contempt penal notice. The warning notice must accompany every child arrangements order, but does not itself satisfy the separate requirements for committal enforcement (see paras [17], [31]-[34]).
