Cases considering section 12 27

Redcar and Cleveland Borough Council v Others (Re B)

[2013] EWCA Civ 964 · 30 July 2013

A residence order confers parental responsibility on its holder for the order’s duration. Accommodation then provided by that court-approved holder is inconsistent with a continuing section 20 duty on the local authority. (see para [40])

A (A Child)

[2008] EWCA Civ 867 · 30 July 2008

The court applies section 12(2) as the statutory route by which a residence order in favour of a non-parent confers parental responsibility while the residence order remains in force. (see paras [3], [65], [70], [80]-[85])

Francis v Secretary of State for Work and Pensions

[2005] EWCA Civ 1303 · 10 November 2005

When a residence order is made in favour of a father who otherwise lacks parental responsibility, the court must confer it. The provision formed part of the comparison between residence and adoption orders (see paras [14]; [17]-[19]). A non-parent favoured by a residence order has parental responsibility while the order remains in force. That continuing relationship and its obligations constituted a personal characteristic for article 14 purposes (see paras [14]; [19]; [27]).
