Cases considering section 155 4

Doorstep Dispensaree Limited v The Information Commissioner

[2024] EWCA Civ 1515 · 9 December 2024Interprets

Empowers the Commissioner to impose a penalty by written notice where the statutory conditions are met. The appeal concerned the burden and penalty assessment under that regime. (see paras [1], [16], [39]) Identifies the statutory conditions which must satisfy the Commissioner before a penalty notice is raised. The Court contrasted that pre-notice satisfaction with the appellant’s burden on appeal. (see paras [16], [39]) Forms part of the statutory failure condition relied on for the penalty notice. The Court treated the appeal as requiring the appellant to establish grounds for displacing the notice. (see paras [27], [39]) Identified as the other statutory condition referred to in the Court’s description of section 155(1). (see para [39]) Requires regard to be had to Article 83(1) and (2) when deciding whether to issue a penalty notice and determining its amount. (see para [16]) Identified as part of the statutory framework reflected in the Commissioner’s penalty-setting guidance. (see para [26])

The Information Commissioner v Clearview AI Incorporated

[2025] UKUT 319 (AAC) · 6 October 2025

Applied in explaining that the Information Commissioner must be satisfied that statutory penalty conditions are met before issuing a penalty notice, while the burden on appeal lies on the appellant (see paras [120]-[124]).

Doorstep Dispensaree Ltd v The Information Commissioner

[2023] UKUT 132 (AAC) · 1 June 2023

The judgment applied section 155(1) in analysing the Commissioner’s power to issue a monetary penalty notice and the significance of the requirement that the Commissioner be satisfied of a qualifying failure. (see paras [48], [179]) The provision was applied with Article 83 of the GDPR when considering the matters relevant to imposing and quantifying the penalty. (see paras [50], [158]) The provision formed part of the statutory framework governing the amount of a monetary penalty and was considered in rejecting the argument that the penalty was essentially criminal in character. (see paras [88], [92], [178])
