Cases considering section 250 20

Halton Borough Council, R (on the application of) v The Secretary of State for Housing, Communities and Local Government

[2025] EWCA Civ 1566 · 3 December 2025

The Court confirmed that section 250(4) supplies the Secretary of State’s broad power to award costs. Its exercise is governed in practice by published Guidance, and the appeal was resolved by applying public-law rationality and reasons principles to that exercise (see paras [14], [29]-[31]).

Halton Borough Council, R (on the application of) v Secretary of State for Levelling Up, Housing and Communities

[2024] EWHC 2030 (Admin) · 21 August 2024Defines

Confirms the statutory source of the broad power to award costs in the inquiry context. The court treated the exercise of that power as primarily entrusted to the costs decision-maker, subject to supervisory review for legal error and public law unreasonableness. (see paras [1], [17], [41])

Harlow District Council v Powerrapid Limited

[2023] EWHC 586 (KB) · 17 March 2023Interprets

The differing wording of section 250(4), referring to costs in relation to the inquiry, did not establish that section 250(5) excluded incidental or other costs. The court treated the distinction as relevant to entitlement, not as imposing an artificial restriction on the amount recoverable. (see paras [44]-[47]) Section 250(5) permits the Secretary of State to order costs of parties at an inquiry and permits the order to be made a rule of the High Court. The court held that such an order may include appropriate pre-notification, incidental and administrative costs unless expressly restricted. (see paras [16], [38], [47], [63]-[64])
