Cases considering Schedule 1, paragraph 4 15

R v Crown Court at St Albans and another

[2018] UKSC 1 · 24 January 2018

The paragraph provides the production-order route for special procedure material. An application concerning journalistic material must be inter partes, which materially distinguishes it from the ordinary ex parte warrant process. (see paras [34]-[36])

LXP, R (on the application of) v Central Criminal Court

[2023] EWHC 2824 (Admin) · 10 November 2023

Applies as the production-order route requiring the person in possession of excluded material to produce it to a constable or provide access. The route is relevant to preserving judicial control over journalistic material (see paras [42]; [69]; [73]).

Jonathan Edward Peter Tipper & Ors, R (on the application of) v The Crown Court at Birmingham

[2022] EWHC 2615 (Admin) · 18 October 2022

Applies paragraph 4 as the less intrusive production-order route against which the need for a search warrant was assessed. (see paras [18]-[20]; [31])
