Cases considering section 302 5

Davis v Leicestershire Constabulary

[2012] EWHC 3388 (Admin) · 18 July 2012Interprets

Interprets the reference to the absence of a forfeiture order as referring to the point when forfeiture can no longer occur, which was when the cash had been returned after withdrawal of the forfeiture proceedings. It did not postpone the limitation period until a later compensation decision. (see paras [10]–[11])

Chief Constable of Cleveland Police v Vaughan

[2009] EWHC 2831 (Admin) · 12 October 2009

Confirms that a claim arising from the detention of the cash should be pursued as a separate compensation claim under section 302. The provision supplied the appropriate route if the police's detention was unjustified. (see paras [15]-[16])

Perinpanathan, R (on the application of) v City of Westminster Magistrates Court & Anor (Rev 1)

[2010] EWCA Civ 40 · 4 February 2010

The restriction of compensation for loss to exceptional circumstances was treated as consistent with applying the public-authority costs principle to failed forfeiture proceedings. (see para [44])

Explanatory note

418.Section 302 provides that where no forfeiture is made following the detention of cash the person from whom it was seized, or the person to whom the cash belongs, may apply to the court for compensation. In most cases, it is thought that the interest that will have accrued from the deposit of the cash into an interest-bearing account as provided in section 296 will suffice. If, after 48 hours, cash has not been paid into such an account, then by virtue of subsections (2) and (3) the court may order the payment of compensation to the value of the lost interest. Subsections (4) and (5) also give the court further discretion to order the payment of reasonable compensation where loss has occurred as a result of the detention of the cash (even taking into account interest and compensation otherwise payable) and where the circumstances are exceptional. This section only applies to compensation for loss incurred as a result of the detention of the cash; if an individual has suffered loss for any other reason, this must be pursued elsewhere.
