Cases considering section 8 3
[2012] EWHC 1105 (QB) · 26 April 2012
Makes contravention of, or failure to comply with, an order under section 6 an offence. The court proceeded on the basis that a private-hire vehicle driver using a taxi-only bus lane would commit that offence on the face of the legislation. (see paras [16], [59])
[2003] EWHC 1181 (Admin) · 6 May 2003
Applies the offence provision to the alleged use of the vehicle in breach of the permit condition. The appeal was allowed and the matter remitted with a direction to convict (see paras [5]-[6]; [23]).
[2014] EWHC 560 (Admin) · 7 March 2014Limits
The court noted that contravention of a section 6 order is ordinarily an offence, subject to the modification applicable where civil penalty enforcement operates. (see para [22])
