Summary

Where a proposed binding compromise of an appeal is disputed and the factual and legal issues cannot be resolved immediately, the court may stay the appeal with judgment undelivered. It may reserve costs, grant liberty to apply, and give directions for proceedings to determine whether the compromise was effective. The stay leaves the court’s final disposition open.

Factual background

The claimant appealed from a decision of the Yeovil County Court before Judge Cotterill. Shortly before judgment was due to be delivered, the claimant contended that the appeal had been compromised. The respondent disputed that contention.

The Court of Appeal explored the factual issues sufficiently to conclude that they raised legal questions which could not be resolved within the available time. The central issue was therefore whether the alleged compromise should be determined through separate proceedings.

Held

  1. The appeal was stayed with judgment undelivered. The court did not determine the disputed question whether a binding compromise of the appeal had been reached.
  2. The claimant was directed to commence proceedings in the Central London County Court by filing points of claim. Directions were given for points of reply, mutual disclosure by list, exchange of witness statements, and an application to fix a hearing and obtain further directions.
  3. The directions could be varied by agreement or order. Application could also be made for an enlargement of time, including where necessary because of an application for public funding.
  4. The costs of the day in the appeal were reserved as costs in the appeal. There was liberty to apply to lift the stay if that became appropriate.
  5. The court expressed the hope that the dispute might still be resolved by a fresh compromise, given the escalating costs.
