The Secretary of State for Education and Skills, in exercise of the powers conferred by sections 22(1) and (2), 42(6) and 43(1) of the Teaching and Higher Education Act 1998( 1 ), hereby makes the following Regulations:
Citation, commencement, interpretation and application
1. These Regulations may be cited as the Education (Grants for Disabled Postgraduate Students) (Amendment) Regulations 2003 and shall come into force on 1 st September 2003.
2. In these Regulations, βthe 2000 Regulationsβ means the Education (Grants for Disabled Postgraduate Students) Regulations 2000( 2 ).
3. The 2000 Regulations shall be amended in accordance with regulations 5 and 6.
4. These Regulations shall not have effect in relation to an academic year (as defined in regulation 2(6) of the 2000 Regulations) which begins before 1 st September 2003.
Amendment of the 2000 Regulations
5. β(1)Regulation 3 shall be amended as follows.
(2) In sub-paragraph (i) of paragraph (2)(a), there shall be omitted the words βthe amount of which is not calculated by reference to his incomeβ.
(3) After sub-paragraph (iv) in paragraph (2)(a), there shall be added β
β (v) any allowance, bursary or award made by the General Social Care Council under section 67(4)(a) of the Care Standards Act 2000 ( 3 ) which includes payment for meeting additional expenditure incurred by the student by reason of his disability; or β .
6. β(1)Regulation 9 shall be amended as follows.
(2) In paragraph (2) for βΒ£5,245β there shall be substituted βΒ£5,370β.
