The Secretary of State makes these Regulations in exercise of the powers conferred by sections 104(1), (2)(d) and (3), 109(1) and (3)(f), 176(1) and (2) and 272(7) and (8) of the National Health Service Act 2006( 1 ).

Citation, commencement and extent

1. —(1) These Regulations may be cited as the National Health Service (Primary Dental Services and Dental Charges) (Amendment) Regulations 2024.

(2) These Regulations come into force on 1st April 2024.

(3) These Regulations extend to England and Wales.

Amendment of the National Health Service (General Dental Services Contracts) Regulations 2005

2. —(1)The National Health Service (General Dental Services Contracts) Regulations 2005( 2 ) are amended as follows.

(2) In Schedule 3 (other contractual terms), in Part 9 (variation and termination of contracts), in paragraph 61A(4)(b) (variation of a contract: rebasing for persistent under performance) for the words from “which may be any date” to the end of that sub-paragraph substitute “which must be no earlier than 1st April in the financial year immediately following the financial year in which the rebasing notice is served on the contractor.” .

Amendment of the National Health Service (Personal Dental Services Agreements) Regulations 2005

3. —(1)The National Health Service (Personal Dental Services Agreements) Regulations 2005( 3 ) are amended as follows.

(2) In Schedule 3 (other contractual terms), in Part 9 (variation and termination of agreements), in paragraph 61A(4)(b) (variation of an agreement: rebasing for persistent under performance) for the words from “which may be any date” to the end of that sub-paragraph substitute “which must be no earlier than 1st April in the financial year immediately following the financial year in which the rebasing notice is served on the contractor.” .

Amendment of the National Health Service (Dental Charges) Regulations 2005

4. —(1)The National Health Service (Dental Charges) Regulations 2005( 4 ) are amended as follows.

(2) In regulation 4 (calculation of charges)

(a) in paragraphs (1) and (5), for “£25.80” substitute “£26.80” ;

(b) in paragraph (2), for “£70.70” substitute “£73.50” ;

(c) in paragraphs (3) and (4), for “£306.80” substitute “£319.10” .

2006 c. 41 . Section 104(3) was amended by section 55(1) of and paragraph 46 of Schedule 4 to the Health and Social Care Act 2012 (c. 7) . Section 176 was amended by section 55(1) of and paragraph 94(b) of Schedule 4 to, the Health and Social Care Act 2012 and by section 1(2) of, and paragraph 1(1) and (2) of Schedule 1 to, the Health and Care Act 2022 (c. 31) . See section 275(1) of the National Health Service Act 2006 for the meaning given to “prescribed” and “regulations”. By virtue of section 271(1) of the National Health Service Act 2006, the powers being exercised by the Secretary of State in the making of these Regulations are exercisable only in relation to England.
