Cases considering Schedule 1, paragraph 3 7

UD v DN

[2021] EWCA Civ 1947 · 21 December 2021Limits

The paragraph expressly limits the duration of periodical payments but contains no equivalent jurisdictional prohibition on capital provision benefiting an adult child. Its language supports the making of a first order after 18 on a timely application (see paras [42], [65] and [72]). The term of periodical payments may start from the application date, demonstrating the practical importance of preserving jurisdiction invoked before the child turns 18 (see paras [60] and [65]). The provision ordinarily restricts the initial period of periodical payments unless the court considers a later date appropriate (see para [42]). Periodical payments ordinarily cannot extend beyond the child’s eighteenth birthday, subject to paragraph 3(2) (see paras [42] and [65]). Its present-tense language supports jurisdiction to make a first periodical-payments order after the child turns 18 where the application was issued earlier and education, training or special circumstances apply (see para [65]). Education or vocational training permits periodical payments to continue beyond the ordinary age limit and supports the availability of adult provision under the statutory scheme (see paras [42], [65] and [72]). Special circumstances may justify periodical payments beyond 18. By analogy with the authorities on capital, the circumstances must establish a genuine continuing need rather than anticipated parental pressure (see paras [65], [72] and [76]–[85]).

P (Child), Re

[2003] EWCA Civ 837 · 24 June 2003Interprets

The court interpreted the Schedule 1 timing provisions as permitting a periodical-payments order to commence before the order where the conditions in the later sub-paragraphs were met. (see paras [59]-[65]) The conditions for retrospective top-up periodical payments were satisfied because a current maintenance assessment was in force and the application was made within the stipulated period. (see paras [60]-[65]) The earliest permitted date was the effective date of the current maintenance assessment, 20 August 2001, rather than a later date. (see paras [60]-[65])

DN v UD€ (Sch 1 Children Act: Capital Provision)

[2020] EWHC 627 (Fam) · 29 January 2020Limits

Applies the ordinary duration limit for periodical payments, while recognising that the court may specify a later date where the statutory conditions are met. (see paras [27], [54], [157]) Confirms that periodical payments ordinarily cannot extend beyond 18, subject to the exceptions in paragraph 3(2). (see paras [27], [54]) Applies the exceptions for education, training and special circumstances. The court treated continuing vulnerability caused by abuse as capable of supporting exceptional capital provision, not merely extended maintenance. (see paras [42], [54], [74]-[85], [161]-[164])
