Cases considering section 229 4
[2022] UKSC 21 · 20 July 2022Limits
The provision permits just apportionment where remuneration relates to a period different from the period for which it was calculated. It is not incorporated into regulation 16 and is not a general power to replace the statutory week’s-pay calculation (see paras [33]; [77]).
[2016] UKEAT 0044_16_1110 · 11 October 2016Disapplies
The court held that the Employment Judge wrongly applied the approach to a week’s pay and just apportionment under this provision. It was irrelevant to the wages and contractual-pay claim. (see paras [37]; [41])
[2011] UKEAT 0048_11_2406 · 24 June 2011
The statutory formula for a week’s pay forms part of the structured calculation of the basic award. The judgment noted the provision but resolved the appeal principally by determining the legally countable period of continuous employment. (see para [6])
