Cases considering section 353 9

Faisal Zahoor Ahmad, R (on the application of) v The Crown Court at Leeds

[2026] EWHC 684 (Admin) · 23 March 2026

Applies the statutory conditions governing search and seizure warrants. The court found the conditions satisfied on the evidence. Applies the reasonable-grounds requirement for suspicion of money laundering. The court held that the evidence provided ample grounds to satisfy the test. Considers the statutory requirements relevant to the alternative conditions for a warrant. The application addressed the statutory criteria and the warrant was upheld.

JOB FOLAYEMI DUROJAIYE (R on the application of) v THE CROWN COURT AT CROYDON

[2022] EWHC 1736 (Admin) · 6 July 2022

The court used section 353 to identify the statutory conditions governing the warrant, including reasonable grounds for suspicion, the existence and value of relevant material, public interest and the risk of serious prejudice. The warrant remained valid despite the non-disclosure. (see paras [12]-[14]; [20]; [32]) The provision was applied as the reasonable-grounds threshold for suspecting that the specified person had committed a money laundering offence. The surrounding financial evidence supported that threshold. (see para [12]) The court treated section 353(5)(a) as requiring reasonable grounds for believing that relevant material was on the specified premises. The anticipated presence of digital material on computers supported the warrant application. (see paras [13]-[14]) The court identified section 353(5)(b) as requiring reasonable grounds for believing that obtaining the material was in the public interest, having regard to the likely investigative benefit. (see para [13]) The court identified section 353(8) as requiring the material to relate to the specified person or the question whether he had committed a money laundering offence, and to be likely to have substantial value to the investigation. (see para [13]) The court treated section 353(9)(c) as requiring a risk that the investigation might be seriously prejudiced unless immediate entry could be secured. The risk of deletion of digital material justified the warrant rather than a production order. (see paras [13]-[14]; [19])

Mills & Anor, R (on the application of) v Sussex Police & Anor

[2014] EWHC 2523 (Admin) · 25 July 2014Interprets

Sets the conditions for issuing a warrant where the production-order route is not relied upon. The court held that the application did not adequately establish the statutory conditions, particularly the need for immediate compulsory entry (see paras [17]-[25], [41]-[46]). Requires the relevant preliminary condition and compliance with either the first or second set of conditions. The judgment treated the statutory alternatives as mutually exhaustive (see paras [17]-[23]). Requires reasonable grounds for suspecting criminal benefit or, in a money-laundering case, commission of an offence. That condition was not disputed in this case (see para [18]). Sets the first set of warrant conditions, including substantial investigative value, public interest and reasons making a production order inappropriate. The court noted that these conditions had not been relied upon and would have been difficult to establish (see paras [19]-[20], [34], [44]). Identifies reasons why a production order may be inappropriate, including impracticability of communication or risk of serious prejudice. The court observed that no such justification had been adequately advanced (see paras [19]-[20], [34], [44]). Sets the second set of warrant conditions. The court held that the police had not shown that this route was necessarily applicable and had not adequately established the access requirement (see paras [21]-[25], [41]-[46]). Covers material in a confiscation investigation that cannot be identified at the time of application but relates to criminal benefit and is likely to have substantial investigative value. The court found it unclear whether the documents could have been identified sufficiently for a production order (see paras [22]-[23], [42]-[44]). Requires reasonable grounds for believing that entry will not be granted unless a warrant is produced. Given the claimants’ history of co-operation and the absence of any request for entry, the court found a substantial basis for concluding that this condition might not be met (see paras [24]-[25], [41], [44]). Addresses serious prejudice to an investigation unless immediate entry is secured, including concealment or destruction risks. The prosecution did not rely on this provision and the judgment noted the absence of any such asserted risk (see paras [24]-[25], [41]).

What each judgment says about section 353 is in the case-law panel in the full Act.

Explanatory note

513.Subsection (1)(b) refers to two sets of conditions for issuing a warrant in the absence of a production order. The first set of conditions (subsections (3) and (4)) might be satisfied, for example, where the person who owns the material is abroad and therefore it is not possible to communicate with that person. In such circumstances, it is clear that a production order in respect of that person would have no effect. The second set of conditions (subsections (5) to (9) might be satisfied where it is impossible to describe the material (for the purposes of a production order) and access will not be gained without a warrant (e.g. to the residence of the suspect).
