Cases considering section 340 87

El-Khouri v Government of the United States of America

[2025] UKSC 3 · 12 February 2025Defines

Interpreted as defining “money laundering”, rather than creating an offence or extending the territorial scope of sections 327–329 (see paras [76]-[82]). Brings foreign acts which would constitute specified offences if done in the United Kingdom within the definition of money laundering. It does not make those foreign acts UK offences and confirms that they are not such offences (see paras [77]-[82]). Defines criminal conduct to include foreign conduct which would constitute an offence in the United Kingdom if it occurred there. This concerns the provenance of property, not the territorial location of the laundering act (see paras [74]-[75]). Defines criminal property by reference to benefit from criminal conduct and the alleged offender’s knowledge or suspicion (see para [74]). Defines property as all property wherever situated, including money. That definition does not extend the territorial scope of the substantive laundering offences (see paras [74]-[75]).

The Director of Public Prosecutions v AA Bholah (Mauritius)

[2011] UKPC 44 · 20 December 2011Interprets

Section 340(3) was interpreted as making suspicion that property represented a benefit from criminal conduct sufficient for the relevant mental element, without requiring identification of a particular crime. The Board equated criminal conduct in this context with the non-specific reference to any crime (see paras [29]-[30]).

R v Mohshin Ali Kamran

[2025] EWCA Crim 247 · 19 February 2025

The court applied the definition of criminal property to money transferred by a victim as a result of fraud. Once received by the intermediary, the money represented, at least indirectly, the fraudsters’ benefit from criminal conduct. (see paras [20]; [23]) The court applied the provision that the identity of the person who carried out or benefited from the criminal conduct is immaterial. The fraudsters’ benefit could therefore render the victim’s fraud-induced transfer criminal property. (see paras [20]; [23])

Explanatory note

497.Subsection (12) ensures that where Part 7 permits disclosure to a nominated officer, (under sections 330, 337 and 338) not only employees, but people exercising functions in relation to an organisation who are not technically employees, will also be able to disclose to a nominated officer, if the organisation has set one up. Directors, partners and volunteers for example will be able to make a report to a nominated officer, if their organisation has one. The liability for reporting to NCIS or a constable, if appropriate, then falls on the nominated officer by virtue of sections 331 and332.

498.Subsection (13) extends the definition of a constable (as used in this Part only) to a person authorised by the Director General of the National Criminal Intelligence Service. This is for the purpose of facilitating the handling of suspicious transaction reports by civilian staff employed by NCIS.
